Acceptance of Terms

By accessing or using SmartRacePix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

What SmartRacePix Does

SmartRacePix is a race photo discovery platform that helps runners find their race photos using facial recognition and bib number search. Photos are provided by race photographers and event organizers.

Your Account

You are responsible for maintaining the accuracy of your account information and the security of your account. You must be at least 13 years old to use the Service.

Content and License

Photographers and race organizers retain full ownership of the photos they submit to the platform. Runners retain full ownership of any selfies they upload. By submitting content to SmartRacePix, you grant SmartRacePix a limited license to store and process that content solely for the purpose of race photo matching and delivery.

Acceptable Use

You agree not to upload images of other individuals without their consent, attempt to circumvent or abuse the facial recognition system, scrape or bulk-download content from the platform, or use the Service for any unlawful purpose.

Disclaimers

The Service is provided as-is. SmartRacePix makes no guarantee that all race photos will be found or that facial recognition matching will be accurate in all cases. Use of the Service is at your own discretion.

Limitation of Liability

To the fullest extent permitted by law, SmartRacePix shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Termination

SmartRacePix reserves the right to suspend or terminate access to the Service at any time, for any reason, without notice.

Changes to These Terms

These terms may be updated from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.
